40two B.V. (“40two” or the “firm”) is a limited liability company registered with the Trade Register of the Dutch Chamber of Commerce under number 98377841. A list of shareholders is available at the firm’s office. The firm uses the word “partner” to refer to a shareholder of 40two or an employee or consultant with equivalent standing and qualifications. Words such as “we”, “us”, “our” or “the firm” or variations thereof mean 40two.

All lawyers of 40two are registered with the Netherlands BAR.

The following lawyers have registered the following principal (and secondary) legal practice areas in the Netherlands Bar’s register of legal areas: Vincent Wismans is registered for Corporate Law; Patrick Munk is registered for Corporate Law; and Tom van den Bosch is registered for Corporate Law. Based on these registrations, they are required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands BAR.

40two cannot receive third-party funds (derdengelden) because 40two has no access to a third-party funds foundation (stichting derdengelden).

Client-attorney relationships are established only upon completion of certain procedures, including executing an engagement letter and performing client identification, conflict checks per Dutch BAR rules, and Client Due Diligence under applicable Anti-Money Laundering (AML) and Counter-Terrorism laws. Furthermore, the firm may be obliged to report unusual transactions. In case of any questions, please feel free to reach out.

Our website and/or service does not intend to collect data about website visitors under the age of 16. Unless they have permission from parents or guardian. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in their children’s online activities in order to prevent data about children being collected without parental consent. For what purpose and on what basis do we process personal data
40two processes your personal data for the following purposes:

handling payments;
being able to call or e-mail you if this is necessary to be able to perform our services;
to deliver goods and services to you;
the provision of legal services, including the performance of a contract, the conducting of legal proceedings, and other services;
the collection of fee statements;
advising, mediating and referring;
marketing and communication purposes;

40two also processes personal data if we are legally obliged to do so, such as on the basis of the law for the prevention of money laundering and terrorist financing which obliges lawyers to report an (intended) transaction that must be characterized as unusual at the Financial Intelligence Unit Netherlands (FIU-NL).

40two does not take decisions on the basis of automated processing about cases that may have (significant) consequences for persons. These are decisions that are made by computer programs or systems, without a human being (for example, an employee of 40two) among them.

40two does not store your personal data for longer than is strictly necessary to realize the purposes for which your data are collected. We use a retention period of 7 years.

40two only provides to third parties and only if this is necessary for the implementation of our agreement with you or to comply with a legal obligation.

40two does not use cookies or similar techniques itself, but uses Google, a web analysis service offered by Google Inc., with regard to the website www.40two.eu. (“Google”). Google Analytics uses cookies to help 40two analyse how you use the website. The information generated by the cookie (including your IP address) is transferred to and stored by Google on servers in the United States. Google uses this information to keep 40two informed about how you use the website, to prepare reports on website activities for 40two and to offer other services related to website activity and internet use.
